The website is published by MAISON MOUCHE, a société par actions simplifiée (French simplified joint-stock company) with share capital of EUR 30,000, registered with the Bobigny Trade and Companies Register under number 890 841 661, EU VAT number FR07890841661, whose registered office is at 13 avenue Francisco Ferrer, 93310 Le Pré Saint Gervais, France, represented by its President, Ms Michiyo Deruelles (“MAISON MOUCHE”).

These Terms apply to any Order placed through the Website. They are brought to the Customer's attention before the Order is confirmed and remain accessible at all times from the Website.

MAISON MOUCHE may amend these Terms at any time. The Terms applicable to an Order are those in force and accepted by the Customer on the day that Order is placed. A later amendment has no effect on Orders already placed.

2. Definitions

Terms means these terms and conditions of sale.

Customer means any natural or legal person placing an Order on the Website.

Order means the Customer's firm order for one or more Products. Creating an account is not required in order to place an Order.

Content means the text, sound, photographs, illustrations, drawings and videos published on the Website by MAISON MOUCHE.

Pre-order means a Product ordered before its release or availability to the public.

Products means the jewellery and other items offered for sale by MAISON MOUCHE through the Website. All Products are new. They are protected by copyright and are the subject of registered design rights; those rights remain the property of MAISON MOUCHE and Ms Michiyo Deruelles, and purchasing a Product transfers none of them.

Website means the online store at www.maisonmouche.fr.

User means any person browsing the Website, whether a Customer or not.

Seller means MAISON MOUCHE.

4. Pre-contractual information

The Customer acknowledges having received, before placing an Order, in a legible and comprehensible manner, these Terms and the information required by article L.221-5 of the French Consumer Code, namely:

•    the essential characteristics of the Product;

•    the price of the Product;

•    all transport, delivery, postage and other applicable charges;

•    the delivery period MAISON MOUCHE undertakes to meet;

•    the identity of MAISON MOUCHE, its company name, postal, telephone and electronic contact details and the address of its establishment;

•    the terms of payment, delivery and performance of the contract, the returns procedure and the conditions for exercising the right of withdrawal, together with the model withdrawal form set out in the annex;

•    information on the legal guarantee of conformity provided for in articles L.217-3 et seq. of the French Consumer Code and the warranty against hidden defects provided for in articles 1641 et seq. of the French Civil Code.

5. Placing an Order

5.1. Selecting Products

The Customer selects the available Products and the desired quantity. Prices are shown in euros, inclusive of all taxes. Delivery charges, delivery times and return arrangements are available on the “Deliveries and returns” page of the Website.

To add a Product to the basket, the Customer selects the size where relevant, then clicks “add to cart”. The Customer may then continue shopping or proceed to payment, or use the “buy now” function, which leads directly to the payment page.

5.2. Pre-orders

Certain Products may be offered for Pre-order, with an indicative release date. MAISON MOUCHE may change that date, in which case the Customer is informed by email.

Where an Order includes a Pre-ordered Product, it is dispatched once all Products are available. A Customer wishing to receive the available Products immediately should place two separate Orders. The estimated delivery date corresponds to the Product with the longest lead time and is displayed before the Pre-order is confirmed.

Quantities may be limited. Should a Pre-ordered Product become unavailable, MAISON MOUCHE will inform the Customer and refund in full the sums paid for that Product.

5.3. Payment and confirmation of the Order

Before finalising the Order, the Customer sees a detailed summary which can be amended. The Customer then enters the delivery address — PO boxes are not accepted — which displays the delivery charges, selects a payment method and enters billing details.

To confirm the Order, the Customer checks the details entered, reads these Terms and accepts them. Final confirmation is made using a button bearing the wording “order with obligation to pay” or equivalent unambiguous wording.

In the event of fraudulent use of a payment card, the Customer informs MAISON MOUCHE at contact@maisonmouche.fr as soon as it is noticed.

The sale becomes final once the Order confirmation has been sent to the Customer by email and payment has been received.

5.4. Order confirmation

The Customer receives confirmation of the Order by email.

5.5. Evidence of the transaction

The computerised records kept by MAISON MOUCHE under reasonable security conditions constitute evidence of communications, Orders and payments. Order forms and invoices are archived on a reliable and durable medium for ten years, in accordance with the statutory obligations to retain accounting records.

6. Conditions of purchase

A Customer who is a natural person must be of age and legally capable of contracting, or place the Order with the consent of their legal representative. A Customer acting on behalf of a legal entity warrants that they are authorised to do so.

Products are intended for personal use. The Customer undertakes not to acquire them for resale.

By confirming an Order, the Customer submits an offer to purchase to MAISON MOUCHE. MAISON MOUCHE may refuse or cancel an Order on legitimate grounds, in particular attempted fraud, unavailability of the Product or breach of these Terms. The Customer is informed and refunded in full any sums paid.

7. Payment and invoicing

The total amount is shown in the summary before the Customer accepts these Terms and confirms the Order. Orders are payable in euros, in full on the day of the Order, by payment card, PayPal or Alma.

Where payment is made by card, the card details are entered via Stripe, a PCI-DSS Level 1 certified provider. Those details are encrypted, never travel in clear text and are never in the possession of MAISON MOUCHE.

7.1. Instalment payment with Alma

•    Payment in three or four instalments is offered through our partner Alma, at no cost to the Customer and with no minimum amount.

•    It requires the Customer to accept the terms or credit agreement offered by Alma. A refusal of credit by Alma may result in cancellation of the Order, in which case the Customer is refunded in full.

•    Payment security is provided by Alma and its own providers; payments are protected by 3D Secure.

•    Alma acts as an independent data controller when assessing the credit file; its own privacy policy applies to that part.

7.2. Refusals and checks

If payment authorisation is refused, the Customer should contact their card issuer. The Customer warrants that they hold the necessary authorisations to use the chosen payment method.

Where there is serious doubt as to a risk of fraud or non-payment, MAISON MOUCHE may ask the Customer for additional supporting documents, such as an identity document or proof of address. Such a request is exceptional and is reviewed by a member of the team: no decision is taken solely on the basis of automated processing. Documents provided are deleted as soon as the check is complete, under the conditions described in the privacy policy. If the Customer does not reply within five days, the Order is cancelled and any sums paid are refunded in full.

8. Product information and availability

Products are described and presented as accurately as possible. Slight variation in colour, inherent to the materials used, does not affect the conformity of the Product. Photographs are provided for illustration; the Customer is invited to read each Product description for its essential characteristics.

MAISON MOUCHE may correct the Content of the Website at any time and may occasionally limit the quantities that can be ordered. If an ordered Product is unavailable, the Customer is informed as soon as possible and may change their choice or cancel the Order, and is then refunded under article 11.3.

9. Prices and delivery charges

9.1. Prices

Products are invoiced at the price in force when the Order is confirmed. Prices are in euros, inclusive of all taxes. They may be changed at any time, with no effect on Orders in progress.

In the event of an obvious pricing error, MAISON MOUCHE informs the Customer as soon as possible; the Customer may then confirm the Order at the corrected price or cancel it and be refunded in full.

9.2. Delivery charges

Shipping charges are available on the “Deliveries and returns” page of the Website.

•    Mainland France, Colissimo with signature, 2 to 3 working days: free.

•    European Union, United Kingdom, Switzerland and French overseas territories, with signature, 5 to 10 working days: EUR 10 — free from EUR 300 of purchases.

•    Rest of the world, with signature, 5 to 15 working days: EUR 35 — free from EUR 500 of purchases.

Shipments are insured up to the declared value of the Products. For deliveries outside the European Union, customs duties or local taxes may apply; these are borne solely by the Customer, who is invited to enquire with the authorities of their country before ordering.

10. Invoicing

Invoices are dated the day the Order is dispatched and sent to the Customer by email.

11. Dispatch and delivery

11.1. Dispatch

The Customer is informed by email when the Order is dispatched. Products are delivered to the address given when the Order was placed.

The Customer must ensure that the information provided is accurate and must inform MAISON MOUCHE, at contact@maisonmouche.fr, of any change to billing or delivery details between the Order and dispatch.

11.2. Delivery

Delivery times are given in working days when the Order is placed and include preparation, dispatch and the carrier's own lead time. If a Product cannot be delivered within the stated time, MAISON MOUCHE will give the Customer a new date by email.

Delivery is deemed complete when the Order is received by the Customer or by a recipient of their choosing. A delivery receipt may be requested for signature.

The Customer is advised to check the condition of the parcel on receipt. If the Products appear damaged, the Customer may refuse the parcel, stating the reason on the carrier's slip, and inform MAISON MOUCHE. This check is a recommendation: it affects neither the legal guarantee of conformity, nor the warranty against hidden defects, nor the right of withdrawal.

If a parcel is returned because the Customer was absent, MAISON MOUCHE will contact the Customer to arrange a second delivery.

11.3. Delay and unavailability

If the agreed delivery date is exceeded, the Customer may require MAISON MOUCHE to deliver within a further reasonable period, in writing on a durable medium. If delivery has not taken place by the end of that period, the Customer may terminate the contract in the same form. The contract is terminated on receipt of that written notice, unless performance has occurred in the meantime.

MAISON MOUCHE then refunds the Customer all sums paid, no later than fourteen days after termination.

If an ordered Product is unavailable, the Customer is informed as soon as possible and may cancel the Order; the refund is made no later than fourteen days after the request.

11.4. Unclaimed parcels

Where a parcel is returned to MAISON MOUCHE by the carrier — incorrect address or unclaimed parcel — MAISON MOUCHE informs the Customer and offers either a further dispatch, the cost of which may be charged to the Customer, or a refund of the Order.

If the Customer does not reply within two months of that notice, MAISON MOUCHE refunds the Products, less the redelivery and return costs actually incurred, and recovers free disposal of the Products.

12. Right of withdrawal, returns and refunds

12.1. Exercising the right of withdrawal

In accordance with articles L.221-18 et seq. of the French Consumer Code, a consumer Customer has fourteen days from receipt of the Product to withdraw, without having to give reasons or bear any penalty.

The Customer exercises this right by sending to contact@maisonmouche.fr, or by post to the registered office, the model form set out in the annex to these Terms or any other unambiguous statement expressing the wish to withdraw.

Withdrawal takes effect on the date that notification is sent. MAISON MOUCHE acknowledges receipt on a durable medium and informs the Customer of the return arrangements.

12.2. Returning the Products

The Customer returns the Product no later than fourteen days after notifying withdrawal, to: MAISON MOUCHE, 13 avenue Francisco Ferrer, 93310 Le Pré Saint Gervais, France. The Customer keeps proof of dispatch.

Return and insurance costs are borne by MAISON MOUCHE. The parcel is returned using the prepaid label provided, from one of the following countries: European Union Member States, United Kingdom, Australia, Canada, South Korea, Hong Kong, Israel, Japan, Norway, Singapore, Switzerland, Taiwan, United States. Any customs charges remain payable by the Customer under article 9.2.

The Customer is invited to return the Product in its original packaging with its accessories, in order to preserve its condition. In accordance with article L.221-23 of the French Consumer Code, the Customer is liable only for any diminished value of the Product resulting from handling other than what is necessary to establish its nature, characteristics and proper functioning. Where applicable, MAISON MOUCHE may deduct from the refund an amount corresponding to that diminished value, and will justify it to the Customer.

12.3. Refunds

MAISON MOUCHE refunds the Customer all sums paid, including the original delivery charges, no later than fourteen days from the date on which it is informed of the decision to withdraw.

MAISON MOUCHE may however defer the refund until the Product has been recovered or until the Customer has supplied proof of dispatch, whichever occurs first.

The refund is made using the same means of payment as the original transaction, unless the Customer expressly agrees to another means and at no cost to them.

12.4. Exchanges

MAISON MOUCHE does not offer direct exchanges. A Customer who wants a different Product exercises the right of withdrawal and places a new Order.

13. Repairs

For any repair or re-plating request, the Customer contacts customer service at contact@maisonmouche.fr. A quotation is sent by email for approval. Delivery costs relating to the repair are borne by the Customer, who may also agree with MAISON MOUCHE on a drop-off address.

Repairs carried out on this basis are separate from the legal guarantees set out in article 15, which are free of charge for the Customer.

14. Accuracy of prices and descriptions

MAISON MOUCHE endeavours to ensure the accuracy of Product information published on the Website, in its advertising and in its catalogues, and the fidelity of photographs and graphic representations. It cannot, however, guarantee the absence of any error, inaccuracy, omission or outdated element.

Where an error affects a delivered Product, the Customer may return it under article 12, without prejudice to the legal guarantees set out in article 15.

15. Legal guarantees

All Products sold by MAISON MOUCHE benefit from the following legal guarantees, which are free of charge for the Customer:

The legal guarantee of conformity, provided for in articles L.217-3 et seq. of the French Consumer Code. It applies for two years from delivery of the Product. During that period the Customer does not have to prove that the lack of conformity existed at the time of delivery: it is presumed. The Customer may obtain repair or replacement of the Product and, in the cases provided for by law, a price reduction or rescission of the sale.

The warranty against hidden defects, provided for in articles 1641 et seq. of the French Civil Code. It allows the Customer to obtain a refund of the price against return of the Product, or a price reduction. Proceedings must be brought within two years of discovery of the defect.

To rely on either guarantee, the Customer contacts MAISON MOUCHE at contact@maisonmouche.fr or by post to the registered office, describing the defect. MAISON MOUCHE will explain how to proceed.

The patina of vermeil and the natural oxidation of silver resulting from normal wear are not lacks of conformity. Care instructions are provided to the Customer with the purchase.

16. Liability

MAISON MOUCHE uses appropriate means to supply quality Products under optimal conditions.

It cannot be held liable where non-performance is attributable to the Customer, to the unforeseeable and insurmountable act of a third party unconnected with the contract, or to force majeure within the meaning of article 19.

MAISON MOUCHE is not liable for use of a Product contrary to the care instructions provided, nor for technical disruption affecting the internet network or the hosting of the Website.

The Website may contain links to sites that MAISON MOUCHE neither publishes nor controls and for which it cannot be held responsible; the presence of a link implies neither approval nor endorsement.

Nothing in these Terms limits or excludes the liability of MAISON MOUCHE where the law does not permit it, in particular in cases of personal injury, gross or wilful misconduct, or breach of the legal guarantees set out in article 15.

17. Customer obligations and security of the Website

The Customer uses the Website in accordance with these Terms and for personal use. The Customer refrains from:

•    using the Website unlawfully or for unlawful purposes;

•    reproducing, copying, renting, distributing, transferring or sub-licensing all or part of the Content, or decompiling or disassembling all or part of the Website;

•    fraudulently accessing the information systems of MAISON MOUCHE, disrupting their operation or introducing malicious software;

•    infringing the intellectual property rights of MAISON MOUCHE or reselling the Products.

In the event of a serious breach, MAISON MOUCHE may suspend the Customer's access to the Website and take any appropriate action, in particular under articles 323-1 et seq. of the French Criminal Code.

18. Intellectual property

All elements of the Website and the Website itself are protected by copyright, trademark law, design rights and all other intellectual property rights, and remain the exclusive property of MAISON MOUCHE worldwide.

Purchasing a Product transfers none of these rights. Any reproduction, in whole or in part, of a MAISON MOUCHE creation is prohibited and may constitute infringement.

MAISON MOUCHE grants the Customer a personal, non-exclusive licence to use the Website for the duration of that use. Any use of the names, trademarks and distinctive signs of MAISON MOUCHE requires its prior written consent.

19. Force majeure

Force majeure means events meeting the criteria of article 1218 of the French Civil Code, together with those usually accepted by the French courts, in particular the blocking of transport or supply routes, fires, storms, floods and interruption of telecommunications networks.

The party relying on force majeure informs the other without delay, and likewise when it ceases. The affected obligations are suspended. If the impediment lasts more than three months, either party may terminate the contract; sums paid by the Customer are then refunded in full.

20. Personal data

Personal data collected when placing an Order or browsing the Website is processed by MAISON MOUCHE as data controller.

The purposes pursued, the legal bases, the retention periods, the recipients of the data and how the Customer may exercise their rights — access, rectification, erasure, restriction, portability, objection, withdrawal of consent, post-mortem instructions — are set out in the privacy policy, accessible from the footer of the Website.

The Customer may send any request concerning their data to contact@maisonmouche.fr and may lodge a complaint with the French data protection authority, the CNIL.

21. Final provisions

21.1. No waiver and severability

The fact that MAISON MOUCHE does not at any given time require performance of a provision of these Terms does not constitute a waiver of the right to rely on it later. If a provision were declared void in whole or in part, the remainder would continue to apply.

21.2. Governing law

These Terms are governed by French law. That choice does not deprive a consumer Customer of the protection afforded by the mandatory provisions of the law of the country in which they are habitually resident.

21.3. Complaints and mediation

The provisions of this article are reserved for Customers who are private individuals purchasing the Products for their own personal needs.

In the event of a difficulty, the Customer first contacts MAISON MOUCHE customer service at contact@maisonmouche.fr. The parties will endeavour to reach an amicable solution.

 

In the event of a dispute relating to these general terms and conditions, the Customer may resort free of charge to a consumer mediator in accordance with Article L152-1 of the French Consumer Code.

21.4. Language

This English text is a translation provided for convenience. In the event of any discrepancy between the English and French versions, the French version prevails.
